Booking Conditions

G.E.T EDUCATIONAL TOURS - GROUP BOOKING CONDITIONS

These Booking Conditions set out the terms on which the School or other group (“School”) contracts with G.E.T Educational Tours Pty Ltd:

  • You means the School or other entity specified in the accompanying Booking Agreement Form.
  • We/us means G.E.T Educational Tours Pty Ltd and our affiliate businesses.
  • Program Leader means the teacher, administrator, or parent from your School or community, who will act as your tour group’s representative.
  • Traveller means a participant in your tour group.

By registering for this program, You are agreeing to these Terms & Conditions which govern participation in a full-service group educational travel experience operated by Us. We will arrange the various travel elements for your trip and pre-trip services, including but not limited to the development of the associated educational content and materials, the printing and distribution of program materials, the costs associated with our various group health and safety measures, and the administrative and service costs related to group management. Because of the unique nature of group travel, many elements of your program and itinerary may be selected and/or scheduled at the direction of your Program Leader.


BOOKINGS

A booking is only accepted when We issue a written booking confirmation, an invoice and a deposit has been received. It is at this point that a contract between Us and You come into existence. We reserve the right to decline any booking request at our discretion. No employee of G.E.T Educational Tours other than a director has the authority to vary or omit any of these Booking Conditions or promise any discount or refund.


SERVICES

The services We provide to You are limited to (a) the arrangement and coordination of your travel arrangements; and (b) the delivery of travel arrangements which We directly control. This includes (often significant) work undertaken prior to travel to arrange and coordinate the delivery of your travel arrangements.

 

PRICES

All quotes are specified in Australian dollars and are subject to change prior to Us accepting your booking request. Prices are based on the quoted itinerary including where applicable, coach transportation, ferry travel, economy class airfares, rail travel and multi-share accommodation.  Prices are also subject to change in accordance with the following provisions.  Note: coach, airline, rail and ferry fares are subject to change without notice at any time prior to full payment. All government taxes and charges imposed by suppliers beyond the control of G.E.T Educational Tours (including ticketing fees and airline fuel surcharges) are payable by You and are subject to change. If there are any increases in such taxes or charges, or if you request any itinerary changes or the number or mix of passengers’ changes prior to You making payment in full, which increases the price of your booking, We reserve the right to change the price at any time by giving You notice.  You must pay the additional charges prior to the date of your departure.

Unless otherwise stated, the cost of travelling to or from departure points, flights, visas, airport taxes, port taxes, city taxes, items of a personal nature, laundry, additional beverages and consumables are not included in the tour price.


FOREIGN CURRENCY EXCHANGE RATE GUARANTEE

Once You have paid Us the deposit, G.E.T Educational Tours will lock in the exchange rate which guarantees the foreign currency exchange rate that applies to the land travel arrangements for the destination. We guarantee the currency exchange rate applying to your land travel arrangements will be fixed and the cost of land travel arrangements will not be affected by unpredictable currency exchange rate fluctuations.

The Foreign Currency Exchange Rate Guarantee is not a price guarantee and G.E.T Educational Tours reserves the right to increase the price of your travel arrangements in the manner specified in the ‘Prices’ provision above.


ACCURACY

G.E.T Educational Tours makes every effort to ensure the accuracy of information in our brochures and on our website but shall not be liable for any damage or loss caused by the change or withdrawal of any price, detail or other item or service.

 

DEPOSIT PAYMENT

A deposit per person is required within 14 days (unless otherwise stated) of Us accepting your booking. The deposit represents a fee payable to Us for services associated with the processing and confirmation of your booking and any consultations on travel arrangements that We may provide to You. Because these services are provided as soon as We confirm your booking, the deposit is non-refundable, other than where We cancel your travel arrangements for reasons other than Force Majeure (see below).

Please note that We may not hold any services for You until We receive payment of your deposit, meaning that services may become unavailable, or prices may increase, in which case You will be responsible for paying the increased price, and We will not be responsible if services become unavailable. 


Australian Domestic tours

A non-refundable deposit is payable within 14 days of issuance of your booking confirmation. The deposit amount is: 

  • If the itinerary price is between $201 and $500:                     $50 per student
  • If the itinerary price is between $501 and $750                      $100 per student
  • If the itinerary price is between $751 and $999:                     $200 per student
  • If the itinerary price is over $1,000:                                         $250 per student

Full payment for air, rail and sea sectors is required no less than 65 days prior to departure. To secure some discount airfares immediately, non-refundable payment in full may be required.

The balance of the land component is required no less than 30 days prior to departure. GST will be charged on the full payment.


International tours

A non-refundable deposit is payable within 7 - 21 days of issuance of your booking confirmation. (Depending on the airline)

The deposit amount is:

  • Tours to the South Pacific:                                                      $400 per student
  • Tours to Asia (China/Vietnam/Japan/Indonesia/Malaysia)      $500 per student
  • Tours to Europe (single country)                                             $1,500 per student
  • Tours to Europe (multiple country)                                          $1,500 per student plus $500 per country visited
  • Tours to the United States                                                       $1,500 per student

On certain occasions, there may be additional deposit amounts required and We will advise at time of confirming your booking. Full payment is required a minimum 90 days prior to departure. Airfare only bookings require a non-refundable deposit of $250 per student to Asia and the South Pacific, $400 to Indonesia and $500 to Europe and the United States. To secure some discount airfares immediately, non-refundable payment in full may be required.

 

FINAL PAYMENT

Payment in full must be received by the date(s) reflected on your invoice. We are under no obligation to remind You of a payment becoming due. If We fail to receive a payment from You by the due date for payment in clear funds, then this will be deemed a cancellation by You (see below). Note: some trips may require payment (including full payment) earlier or in additional instalments and this will be advised with the booking confirmation. 

Non-refundable fees: Your deposit, insurance premium, any handling charges, merchandise fees, fees for declined credit cards or electronic drafts, late payments, and registration fees are not refundable unless required by law. In particular, there are certain guarantees, warranties and rights imposed by law in relation to our services which cannot be excluded, restricted or modified or may only be limited to a certain extent (Statutory Obligations) and which may entitle You to a refund of these fees in certain circumstances. Nothing in this clause excludes, restricts, or modifies the Statutory Obligations in relation to these fees.

Late payment and fees: The late fee for any payments made after a scheduled payment date is $50 per Traveller. There is a $35 service charge on returned, declined credit cards or declined online banking payments.

Waitlist: Your tour is not guaranteed until your account has been paid in full and all conditions for travel have been satisfied. If You are placed on a waitlist due to late registration or an outstanding account balance after final payment your account must clear waiting list procedures and may involve additional airline and other charges.


CANCELLATIONS OR RESCHEDULING BY US

Cancellation due to Exceptional Circumstances:

In Exceptional Circumstances (explained below), We may need to postpone or (if postponement is not achievable) cancel your trip. In such circumstances, if your group is unable or unwilling to reschedule your trip to a new destination or date, We will refund all Traveller’s monies paid less Non-Refundable Fees (as described above) and an additional cancellation fee of $795 per Traveller. You accept that these fees are a fair estimation of a portion of the unrecoverable internal and external costs related to planning, managing, and administering a full-service group travel program, that We incur prior to the date of departure.


Exceptional Circumstances:

Exceptional Circumstances include, but are not limited to, acts of Force Majeure, war (whether declared or not), criminal or terrorist activities of any kind or the threat thereof, civil unrest, strikes or other restrictive labor activities, illness or disease, actual, perceived or threatened epidemics or pandemics, government-imposed travel restrictions or closures, and other events outside our control that make performance of a trip as contemplated impossible or impractical.

You acknowledge that the terms in this section are reasonably necessary to protect our legitimate business interests. We strongly encourage You to purchase travel insurance that adequately responds to cancellation and rescheduling risks associated with Force Majeure events.

 

AMENDMENTS BY YOU

We will endeavor to accommodate changes and additional requests. You acknowledge that changes and requests may not be possible to fulfil.

If We are able to fulfil any changes or requests, You agree that an amendment fee of $150 per request is payable. You also agree to pay any pre-payable taxes, levies or charges and any additional costs passed on by our suppliers in connection with the change or request.

Requests for an individual to travel outside the group’s designated dates are subject to availability and will incur an additional charge of $195 per person plus any charges that our suppliers may pass on to G.E.T Educational Tours.

A $50 fee, plus any additional airfare costs, will be assessed if You cancel your reservation and choose to re-instate at a later date.


CANCELLATIONS BY YOU

General cancellations by You

All cancellations must be received in writing. Because We incur costs from when We confirm your booking, the following cancellation charges will be payable:

 

Domestic Tours

Every effort will be made to adhere to the published touring itinerary. Occasionally, circumstances beyond our control will force changes, amendments or modifications to the itinerary and its inclusions. To the fullest extent permitted by law, G.E.T Educational Tours will not be responsible for any omissions or modifications to the itinerary, or the inclusions made as a consequence of these circumstances. If You are entitled to any compensation at law for any changes or modifications in these circumstances, then You agree that any compensation You are entitled to will be reduced by the value of any alternative services We provide that You accept.


PASSENGER NAMES

Flight, rail and ferry reservations cannot be confirmed without passenger names. You must, at the time of booking, advise correct names for all members of the Travelling Party. Name changes after tickets have been issued are not always possible. If a name change is possible, this will result in the issuance of new tickets, which may include a higher fare. We disclaim any liability for any loss or expenses caused by a failure to comply with these requirements, and We accept no responsibility for additional charges or inability to travel due to incorrect names being advised. 


ITINERARY VARIATIONS

Every effort will be made to adhere to the published touring itinerary. Occasionally, circumstances beyond our control will force changes, amendments or modifications to the itinerary and its inclusions. To the fullest extent permitted by law, G.E.T Educational Tours will not be responsible for any omissions or modifications to the itinerary or the inclusions made as a consequence of these circumstances. If You are entitled to any compensation at law for any changes or modifications in these circumstances, then You agree that any compensation You are entitled to will be reduced by the value of any alternative services We provide to You which you accept.


CHANGE OF ACCOMMODATION

In the unlikely instance of an accommodation change becoming necessary the alternative property will be of a comparable or higher standard and there shall be no refund in this respect. 


UNUSED SERVICES

No refund is given for any partially or wholly unused services/ tour inclusions. No supplier or agent or employee of G.E.T Educational Tours is authorized to promise a refund other than a director.


INSURANCE

It is the condition of travel that each passenger travelling is adequately covered by comprehensive travel insurance for the duration of your tour with Us. Your travel insurance policy must provide adequate cover for participation in all included activities as part of the tour. Please check the details within your product disclosure statement and ensure You are aware of its conditions and omissions.

Travel insurance is strongly recommended for all Travellers travelling with Us. We offer an insurance policy tailored to protect your educational travel investment.

Please note, Travellers are solely responsible for their pre-program, program, and post-program medical care in all respects, including, but not limited to, obtaining and taking necessary medication(s), vaccinations, and any other medical care and treatment.


TRAVEL DOCUMENTATION

You must provide Us with the following information for each Traveller on your tour: full name (as per Passport or Visa), gender, date of birth, travel insurance selection. We must receive these details no later than 70 days prior to departure.

You are responsible for ensuring that every Traveller has the required documentation, passport or visa, necessary to participate in the trip prior to the date of departure, including date of birth and necessary identification that fully matches the name provided to Us for inclusion on travel documentation and airline tickets, and meets any other applicable compliance requirements issued by government or related agencies.

We provide customer service to keep the Traveller's  information current, and it is your responsibility to ensure that this information is fully up to date no later than 60 days prior to the group’s departure date. If changes occur after that date, You must contact Us to ensure the information is corrected and additional change fees may apply. If a Traveller is unable to travel due to the lack of proper identification, passport or visa, or necessary inoculations, the standard cancellation policy will apply. Reservations are not transferable at any time.


SPECIAL DIETARY REQUESTS

Special dietary requirements will only be accepted on the G.E.T Educational Tours Dietary Requirements template or name list, which We will provide at the appropriate time. We may require a medical certificate to support special dietary requirements (excluding religious or vegetarian requirements). Note that some venues and hotels may impose additional charges to comply with dietary requirements. We will pass these additional charges on to You, which You agree to pay. 


MEDICAL INFORMATION

We rely solely on the medical information on members of the Travelling Party as provided by the School. We reserve the right to exclude any passenger from a tour if We, acting reasonably, consider that the passenger requires special assistance on a condition either not previously advised or not fully disclosed. 

We will not be liable for any damage, injury, death or loss of any kind arising from your failure to disclose relevant medical information.


SUPERVISION / BEHAVIOUR

We, the Program Leader, and chaperones establish behaviour rules and directions for all student Travellers. Failure to abide by the rules or directions may result in the student being sent home at the parents’ expense without any right to a refund. All Travellers will be responsible for their own actions at all times, and the Program Leader and chaperones will be held accountable for the action of all Travellers.

Consumption or possession of alcoholic beverages or drugs of any kind for which You do not have a valid prescription, behaviour infringing upon the ability of others to enjoy the tour, or compromising safety, or is otherwise inappropriate, or violates the law as well as violation of certain other rules, constitute grounds for immediate expulsion.

We are committed to providing an environment that is free from harassment. Harassment based upon an individual’s sex, race, ethnicity, national origin, age, religion, or any other legally protected characteristics will not be tolerated.

 

On occasion, Travellers may be allowed by the Program Leader to leave the group and to explore on their own. We are not responsible for Travellers when they are on their own and it is the sole responsibility of those Travellers to take whatever actions are necessary to rejoin the group, at their own cost. If a Traveller is late for a scheduled departure, the itinerary will not be delayed waiting for the Traveller. In these circumstances, the Traveller must bear the costs of rejoining the group as soon as possible.


COMPLAINTS

In the event of a problem with any aspect of your tour, You are obliged to make a G.E.T Educational Tours representative or a local supplier aware of such problems immediately.

We will only consider claims where We or our suppliers have had the opportunity to put things right at the time, and where the claim has been received by Us, in writing, within 30 days from the end of the services provided by Us, otherwise You will not be able to make the claim.


RESPONSIBILITIES

Australian Consumer Law and corresponding legislation in other jurisdictions in certain circumstances imply mandatory conditions and warranties into consumer contracts (“Consumer Warranties”). These conditions do not exclude or limit the application of the Consumer Warranties. Other than the Consumer Warranties, G.E.T Educational Tours disclaims all warranties.

To the extent permitted by law, the maximum liability of G.E.T Educational Tours to You under these conditions, in tort (including negligence) or at law is limited to arranging for the travel arrangements to be resupplied or payment of the cost of having the travel arrangements resupplied.

This agreement shall be governed and controlled in accordance with the laws of Victoria, Australia. If any provision of these conditions is found to be unenforceable, then it will be severed from these conditions without affecting the remaining provisions.


SERVICES SUPPLIED BY INDEPENDENT SUPPLIERS

Where a third party over whom We have no direct control (Independent Supplier) is the supplier of travel arrangements that form part of your trip, You acknowledge that our obligations to You are limited to taking reasonable steps to select a reputable Independent Supplier and arranging for them to provide those travel arrangements to You. Independent Suppliers over whom We have no direct control include but are not limited to airlines, railway and cruise operators, hoteliers, independent transport companies (i.e., vehicles not operated by Us) and common carriers.

To the fullest extent permitted by law, We will not be responsible to You for any loss, damage, personal injury or delay attributable to the actions or omissions of an Independent Supplier.  Any claims You have in this regard must be made against the Independent Supplier. You acknowledge that the Independent Supplier’s liability to You may be limited by their own terms and conditions.  

 

SERVICES WE DIRECTLY SUPPLY

To the extent only that We are the principal supplier to You of travel arrangements or other services which We control, then We will provide those travel arrangements and services with reasonable skill and care.

We will only be responsible for our employees in the course of their employment, and for our agents and suppliers (where We are not the supplier’s agent or where the supplier is not an Independent Supplier) if they were carrying out the work, We had asked them to do. 

We will not be responsible for any loss, damage, claim, or expenses caused by the acts or omissions of You, of any other third party not connected with the provision of the travel arrangements or services, or due to an event of Force Majeure.

While We endeavor to meet scheduled arrival and departure times, We cannot guarantee this. We will not be responsible for any loss or additional expenses You incur for any missed connections/services attributable to delays.  

GENERAL LIABILITY LIMITATION

You acknowledge that travel arrangements or services which comply with local laws and regulations will be deemed to have been properly performed, even if this would not be considered the case in Australia.

Australian Consumer Law and corresponding legislation in State jurisdictions in certain circumstances imply mandatory conditions and warranties into consumer contracts (“Consumer Warranties”). These Booking Conditions do not exclude or limit the application of the Consumer Warranties. Other than the Consumer Warranties, We disclaim all warranties.

To the fullest extent permitted by law, our maximum liability to You under these Booking Conditions, in tort (including negligence) or at law is limited to arranging for the travel arrangements to be resupplied or payment of the cost of having them resupplied. 

 

PRIVACY STATEMENT

G.E.T Educational Tours respects your privacy and will only use your personal information in accordance with our Privacy Policy and in accordance with the Privacy Act 1988.
